I don't have a horse in the race, however, referring to the three named issues with the bill as unconstitutional without a deeper analysis is haphazard journalism. Precedent from the Court has upheld requiring (1) informed consent, (2) a reasonable waiting period and (3) an examination by a doctor to confirm the fetus has not reached viability.

Certainly valid arguments can be made in reference to the meaning of "informed consent" and who is responsible for the content of the information. The 24 hr waiting period almost certainly would be found to fit within the "reasonable time" parameter. As far as requiring those seeking abortions to foot the bill for a statutorily required procedure, I suspect that is the prong most vulnerable to attack. Such a requirement could have the effect of imposing and undue burden on indigent women.

I claim no endorsement for this bill and know little of it other than the sparse facts stated here, however, this article fails at supporting the conclusions it draws.
