16 and 17 year olds should not be charged as adults except for the most heinous of crimes and certainly never for non-violent crimes be they felonies or misdemeanors. Even then there should be a probable cause hearing before a judge to determine if such a procedure is appropriate.

Even at 3.3 Billiion it's still worth it. The USA desperately needs to transition to public transportation. Public transportation and its peripheral industries will create jobs that will get reduce unemployment and generate more money and tax revenue into the economy. It will also reduce our dependence on fossil fuels. Even if it is used by low income people and students, there are many more of them than rich people.

If the allegations are true, particularly the ones about the embezzlement of withholding taxes, an independent audit by the IRS and SBI is necessary. This sounds like serious financial mismanagement.

With all the science that has been developed associating hydraulic fracturing with earthquakes and contamination of drinking water, I think it's incumbent on both the legislature and the MEC to immediately order a moratorium on drilling anywhere until these risks can be fully and properly assessed. I know many people in the affected areas do not have earthquake insurance.

It's black letter law in the United States that an illegal search cannot be justified by the discovery of contraband. That has been true for many decades of 4th Amendment jurisprudence. I admit, especially with the weak and equivocal consent, it's a close case. We don't know if he actually gave the consent, or if he was told he would be detained even longer if he didn't (a standard police tactic), in any case the new rules require written consent so as to avoid these issues. Finally, even that it is a close case, searches and seizures without the benefit of a warrant are per se unconstitutional, except in narrow and carefully drawn exceptions. Judge Baddour was absolutely right in his decision, especially given the latest decision from the Supreme Court referred to in the article. No one wants to put a heroin trafficker back on the street, but upholding the Constitution is paramount no matter how difficult it is; especially with the many attacks on it from all strata of government.
