Regarding the ESC/COMMERCE bill. Thank you for your nice piece covering this item amongst so many important issues.

Your caveat refers to a very narrow set of statutory exceptions regarding eligibility. Even this bill doesn't change that. The core assertion that you can't quit or get fired for cause and collect benefits remains true and unchanged, even by this law.

Rep LaRoque seemed to be confused about what the agency actually does and what this bill purports to do. His odd mistrust of people caught up in this terrible economy and who are unemployed "through no fault of their own" is not borne out by the facts. It is a misplaced and weak platform for decision making in a legislative environment.

His posture and the process of the sub committee illustrate the genuine dangers of legislating without taking the time to understand the issue. The fall back position from such bald assertions is a lame reliance on "what they tell me" and "I know people who..."

Fully half of the folks, employer and employee in hearings lose and are free to cry bias to their hearts content. In my experience we had to deal with the charge of a pro-industry bias just as much. The data, if we had been allowed to present it, reveals that the case results are split 50-50. About 80% of employers win on appeal.

In a short period of time we recovered more than 24 Million from employer fraud. It came from big named NC companies of the type that the Department of Commerce is distributing money to as inducement to expand. What is the chance that Commerce will vigorously pursue them for fraud..or that you will ever know about it?
