There are two possible explanations for not notifying the county in a timely fashion.

the first, to quote Steve Martin, is "I forgot."

the second is that, by not making the easement public, the developers maintain the advantage in that the ruling that the protest petition is now invalid doesn't come out until the last minute, and opponents of the project are effectively disenfranchised with no recourse.

I give Byker full marks for this move. It's brilliant.
