Ah, but the decision to appeal is not Rep. Moffit's to make. It is NC Attorney General Roy Cooper's decision and he has 30 days to do so, according to a recent entry in Ashevillewater.blogspot.com So, the man who appears to want to be NC's next Democrat governor could end Asheville's misery right now and save her citizens from having to pay for an appeal. He has grounds to say the case has already had a fair hearing in the courts: 1) Republican legislators OKed Judge Manning hearing the case . 2) Judge Manning has previously ruled in favor of the General Assembly and against the City of Asheville in a case involving Asheville's water system.
