A few thousand dollars is nothing when in return you receive development rights worth millions. This whole thing is appalling. I'd say the 751 South Three should be ashamed, but they obviously feel none.
$2,000 a day - wow! SDD must be barely scraping by. They are the victims in this rezoning story.
There's absolutely no way that the Durham City Council should consider the annexation of the 751 South tract until the legal process is resolved.
FWIW - almost all of the homes in Colvard Farms, including the two owned by Alex Mitchell who is "proud and fortunate to call Durham home", are located in Chatham County and therefore Durham zoning and other legal rules wouldn't apply.
The under-reported story in all of this is how the legal rights of Durham citizens, the nearest neighbors to the 751 Assemblage, were purposefully subverted throughout the entire rezoning process.
So much for siding with the little guy...
The whole thing is set up to have the ruling occur during the BoCC hearing. This way when the revocation is found invalid then a vote can be taken. As anyone who remembers Bush v. Gore from 2000 can remember, being declared victorious first (even under highly dubious circumstances) goes a long, long way towards winning. The whole crew in this case learned from their earlier mistake in making the easement public that giving the good people of Durham any time to fight back is far too long.
When Lowell Siler said he needed a day or two to make a decision and Page postponed the hearing for two weeks, I thought there's no way that Siler can sit on this decision for two weeks. I mean, it'll just look so, so bad. I guess I was wrong. Lowell Siler -- this is your career. North Carolina is watching.
