Erick Daniels freed

Durham Superior Court Judge Orlando Hudson dismissed all charges against Erick Daniels, who has served seven years in prison for a robbery he did not commit.

Hudson ruled on three points: Daniels, who was 15 at the time of his conviction, had ineffective assistance of counsel during his trial; Durham County Prosecutor Freda Black failed to turn over exculpatory evidence; and there is new evidence that points to his innocence.

In 2001, a jury convicted Daniels of robbing and burglarizing the home of Ruth Brown, a police department employee; a judge sentenced Daniels to 10 to 14 years in prison.

Black won the case without incriminating physical evidence, relying instead on the victim's eyewitness testimony, which evidence suggests was flawed. Daniels, who was 14 at the time of the robbery and 15 at trial, has always maintained his innocence. A 2007 investigation by Mosi Secret in the Independent, "Stolen youth," supported Daniels' claims.

This is wonderful. I went to one of the links and read the many comments posted by earlier readers. I hope those naysayers choke on their opinions now that he has been freed for a crime he did not commit. Also I'm wondering if many will support this young man and his mother (who fought for her son's release) if they decided to sue for his wrongful imprisonment just as the Duke Lacrosse players are now doing...especially as they served not one day in jail and this guy spent seven years behind bars for a crime he did not commit. The cynic in me says probably not.

It is a shame that black people always have to go the extra mile to proven themselves. Black people often lack the fundsto have some fight in their behalf and it shows how the legal system is often used against Black people to perform what has always been for those in charge genocide.

So it looks like there was a BLACK complainant who wrongfully fingered Daniels for the crime. There was a BLACK lawyer who failed to adequately defend him -- in fact, he did the prosecution's case for it. A lot of BLACK people in Daniels' neighborhood seem to have known the real story, but they wouldn't "snitch" to save Daniels. And somehow this is all whitey's fault? Btw, I don't see the part of the story where mobs of people gathered outside the Daniels' home with banners that said "CONFESS" and "CASTRATE". And did I miss the part where trial spectators shouted at Daniels "DEAD MAN WALKING!" No? No, this isn't like the Lacrosse Hoax at all. The Lacrosse Hoax was a citywide effort to frame three white boys. The Daniels case was a black-run hoax to get one bad boy off the street while protecting who knows how many others.
